1. Service Description

Veila is a privacy-focused chat interface that allows users to interact with flagship AI assistants while protecting user data through end-to-end encryption. Our service connects you with AI models from leading providers while ensuring your conversations remain private and secure.

2. Acceptance of Terms

By accessing or using Veila, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

3. User Accounts and Credits

3.1 Credits System

• Credits are purchased at $0.01 per credit (1 cent per credit)
• Each AI model has specific pricing for input and output tokens
• The cost for each prompt is calculated based on token usage and automatically deducted from your account balance
• Credits expire 3 years from the date of purchase
• You are responsible for monitoring your credit balance

3.2 Account Responsibility

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate information when creating your account
• You are responsible for all activities that occur under your account

4. Acceptable Use

4.1 Prohibited Activities

You agree not to use Veila for:

• Any illegal activities or content
• Violating any applicable laws or regulations
• Attempting to gain unauthorized access to our systems
• Interfering with the proper functioning of the service
• Harassing, abusing, or harming others
• Any activities that violate third-party AI provider usage policies, including but not limited to OpenAI's Usage Policies
• Generating content that could be harmful, dangerous, or inappropriate
• Creating content for minors without appropriate parental consent

4.2 Content Responsibility and Third-Party Compliance

• You are solely responsible for the content of your conversations and all outputs generated
• We do not monitor, review, or control the content you submit
• You must comply with all third-party AI provider terms of service and usage policies
• Violations of third-party provider policies may result in immediate account termination
• You acknowledge that AI-generated content may be inaccurate, inappropriate, or biased
• You are responsible for reviewing and validating all AI-generated outputs before use

5. Free Tier and Abuse Prevention

5.1 Free Tier Policy

• Free tier credits are provided at our discretion to allow users to evaluate our service
• Free tier is intended for personal use by individual users only
• Users are limited to one account per person to ensure fair access for all users

5.2 Abuse Prevention and Fair Usage

To prevent abuse and ensure fair access to free tier resources:

• Signal Collection: We collect device fingerprints, device identifiers, and IP addresses to detect multiple account usage
• Account Restrictions: Users who create multiple accounts may have their free tier credits restricted or revoked
• Account Blocking: New account creation may be temporarily blocked if our systems detect potential abuse
• Automated Enforcement: These restrictions are applied automatically based on our abuse prevention algorithms

Legitimate Shared Usage: We recognize that multiple users may legitimately share networks (offices, cafes, families). If you believe you've been incorrectly restricted, contact support@veila.ai with details about your situation.

5.3 Appeals and Resolution

• Users may appeal abuse prevention restrictions by contacting support@veila.ai
• Include your account details and information about any shared networks or devices
• We will review appeals within 5 business days
• Our decision on abuse prevention matters is final

6. Payment and Refunds

6.1 Payment

• All purchases are final upon completion
• Credits are non-transferable
• Prices are subject to change with notice

6.2 Refunds and Cancellations

If you are a consumer, you have the right to cancel your purchase within 14 days of buying credits without giving any reason, with the exceptions pointed out below. To cancel, contact us at hey@veila.ai. We will process your cancellation and refund without delay through the original payment method.

You can exercise your right to cancel, as long as you haven't started using the credits you purchased. For credit purchases through a subscription, your right to cancel is only present following the initial subscription and not upon each automatic renewal.

Once you've started using your credits, this right no longer applies. However, if something isn't right, contact us at hey@veila.ai — we're happy to help.

7. Privacy and Data Protection

• Your conversations are stored end-to-end encrypted and can only be decrypted by you

8. Service Availability

8.1 Service Provision

• We strive to provide reliable service but do not guarantee uninterrupted availability
• We may suspend or terminate service for maintenance, security, or other operational reasons
• We are not liable for any disruption in service availability

8.2 Third-Party Dependencies

Our service relies on third-party AI providers (e.g. OpenAI, Anthropic). Service availability may be affected by these providers' terms and availability.

9. Intellectual Property

• Veila and all related materials are owned by us or our licensors
• You retain ownership of your input content
• AI-generated responses are subject to the intellectual property terms of the respective AI providers

10. Limitation of Liability

To the maximum extent permitted by law, Veila shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

10.1 Third-Party AI Services Disclaimer

IMPORTANT: This service connects to third-party AI providers (including OpenAI). We act as an intermediary and are not responsible for:

• The accuracy, appropriateness, or reliability of AI-generated content
• Any harm, damage, or legal issues arising from AI outputs
• Changes to third-party provider policies or service availability
• Any violations of third-party provider terms by users

11. Disclaimers

• The service is provided "as is" without warranties of any kind
• We do not warrant that the service will be uninterrupted or error-free
• AI responses are generated by third-party systems and we do not guarantee their accuracy, appropriateness, safety, or compliance with any particular standards
• AI-generated content may contain errors, biases, or inappropriate material
• Users must evaluate all AI outputs for accuracy and appropriateness before use
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose

12. User Indemnification

You agree to indemnify, defend, and hold harmless Veila and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from:

• Your use of our service in violation of these terms
• Your violation of any third-party rights, including intellectual property rights
• Your violation of any applicable laws or regulations
• Your violation of third-party AI provider terms of service or usage policies
• Any content you input into or generate through our service
• Any harm or damage caused by your misuse of AI-generated content

13. Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these terms of service
• Violation of third-party provider policies
• Abuse prevention violations (including multiple account creation)
• Any other reason at our sole discretion

Upon termination, your access to unused credits will be forfeited without refund. Accounts terminated for abuse prevention violations are not eligible for credit refunds.

14. Age Restrictions and Parental Consent

You must be at least 13 years old to use Veila. Users between 13 and 18 must have verifiable parental consent. In accordance with third-party AI provider requirements, we may request verification of age or parental consent at any time. Parents and guardians are responsible for monitoring and controlling minors' use of AI services.

15. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Switzerland.

16. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by:

• Posting the new terms on our website
• Sending email notification to registered users (if an email address was provided)
• Providing prominent notice within the service

Your continued use of the service after such modifications constitutes acceptance of the updated terms.

17. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms will remain in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Veila regarding the use of our service and supersede all prior agreements and understandings.
